Terms of Service Agreement
This Terms of Service Agreement (the "Agreement") is between FCC First Class Contracting Ltd. (referred to as "us," "we," or "our") and you ("you" or "your"), as a user of our services. By accessing or using our services, you agree to be bound by these terms and conditions. If you do not agree with any part of this Agreement, you should discontinue use of our services.
1. Services Provided — FCC First Class Contracting Ltd. offers a variety of services, including but not limited to general contracting, custom home renovations, and construction project management. Our services may be subject to additional terms and conditions, which will be provided separately when applicable.
2. Payment Services — rendered by FCC First Class Contracting Ltd. require payment in full as per the terms agreed upon prior to commencement. Our payment terms are detailed in agreements or invoices provided. Payments are non-refundable except as mandated by law or otherwise detailed in specific agreements.
3. Refund Policy — Payments for services rendered by FCC First Class Contracting Ltd. are considered final. Refunds are not issued unless outlined in a separate agreement or necessitated by law.
4. Intellectual Property — The intellectual property rights for all materials provided by FCC First Class Contracting Ltd., including designs, plans, and proprietary methodologies, remain with us. These materials may not be reproduced or modified without explicit written consent from FCC First Class Contracting Ltd.
5. Disclaimer of Warranties — FCC First Class Contracting Ltd. provides services subject to a limited warranty which will be stated in the service agreement outlines.
6. Limitation of Liability — FCC First Class Contracting Ltd. is not liable for indirect, incidental, special, or consequential damages resulting from the use of our services, irrespective of the cause of action.
7. Indemnification — You agree to defend, indemnify, and hold harmless FCC First Class Contracting Ltd. from any claims or demands, including reasonable attorneys' fees, arising from or related to your use of our services.
8. Modification of Terms — FCC First Class Contracting Ltd. reserves the right to alter these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.
9. Governing Law —This agreement is governed by the laws of British Columbia, Canada. Disputes arising hereunder shall be resolved in Vancouver, BC.
10. Entire Agreement — This document represents the whole agreement between you and FCC First Class Contracting Ltd. concerning the provision of services.
11. Acknowledgment — By utilizing our services, you confirm understanding and agreement to these terms.
